Jail inmate notary FAQ
Questions about inmate notarization in California.
Can an inmate legally sign documents while in custody?
Yes. Custody does not remove a person’s right to sign documents. A California notary may proceed when the inmate is mentally competent, signs voluntarily, and has satisfactory identification. Incarceration alone does not affect legal capacity.
Can a domestic partnership be filed if one partner is in jail?
Yes. The California Secretary of State accepts a Declaration of Domestic Partnership when one partner is incarcerated, as long as both partners are notarized on the same original form. We notarize both partners and file the form with the state as one all-in package — see our jail domestic partnership notary and filing page.
How long does clearance take before a notary visit?
Clearance time varies by facility. Most LA County jails require 24–48 hours notice for professional visits. Attorney-sponsored visits may clear faster at some facilities. Federal facilities such as MDC Los Angeles use a separate Bureau of Prisons clearance process that can take longer. Call us as soon as you know you need the visit — we begin the clearance process immediately.
What ID does the inmate need for a notary appointment?
No personal photo ID is required at a local detention facility. California Civil Code § 1185(b)(3)(D) allows sheriff-issued inmate identification. At county jails, we match the booking wristband to the sheriff’s booking record. Federal facilities use a different process. At MDC Los Angeles, identification is matched to the BOP wristband, federal register number, and BOP record. Give us the inmate’s full legal name and booking number when you call.
Does the notary need to go through an attorney to get access?
No. Notaries enter facilities as professional visitors, not as attorneys, and attorney-of-record clearance is not required at most county jails. However, working through an attorney of record can sometimes streamline scheduling at certain facilities. If your attorney prefers to sponsor the visit, we coordinate with their office directly.
Can family members be present during the notary appointment?
No. Only the notary is admitted to the professional visitation area. Family members may wait in the public waiting room but cannot join the signing. If a document also needs a family member’s signature, we notarize that signature separately outside the jail and combine the completed documents.
Do you do weekend or evening notary visits at jails?
Weekend and evening availability depends entirely on the facility's professional visitation hours. Some county jails accommodate weekend professional visits with advance notice; others restrict access to weekdays. We confirm the facility's schedule and available appointment windows when you call.
What does a jail notary visit cost?
Adult jail visits range from $200 to $350, based on typical travel distance and appointment time from Granada Hills.
- $200: Los Angeles County facilities
- $225: Orange and Ventura County facilities
- $250: San Bernardino Valley facilities
- $275: Riverside-area facilities, High Desert, and Santa Barbara Main Jail
- $300: Extended-distance facilities in Indio, Santa Maria, and Bakersfield
- $350: Federal facilities such as MDC Los Angeles
California notary fees are capped at $15 per signature under Government Code § 8211. We confirm the final rate before scheduling if unusual traffic, after-hours travel, or facility procedures materially change the visit. View the complete jail pricing table.
Is Century Regional Detention Facility (the women's jail) different from the other facilities?
Yes. Century Regional Detention Facility in Lynwood is LA County’s dedicated facility for women in custody. Its policy lists “Notary” as a separate professional-visitor category, distinct from public visiting. We schedule CRDF appointments within that specific professional window.
What happens if the inmate is transferred before the appointment?
If an inmate is transferred between booking and the scheduled appointment, you may still be responsible for a trip fee if we are already en route. To reduce this risk, we recommend confirming the inmate's location with the facility on the day of the appointment, especially when transfer is possible. We will rebook at the new facility as quickly as clearance allows.
Do you serve jails outside Los Angeles County?
Yes. We serve facilities across Orange, Riverside, San Bernardino, Santa Barbara, and Ventura Counties in addition to all six major LA County jails. Extended-area facilities may carry additional travel fees. Call or text (213) 933-2507 for a quote specific to your facility.
